The hearing panel concluded that the respondent should be reprimanded for falsely stating to a client that he had made certain telephone calls on their behalf in connection with a real estate matter and for his negligence in failing to properly safeguard his clients' property, to wit, a $500 check to be held as an earnest money deposit. The respondent's conduct was deemed to be in violation of MCR 9.104(3) and Canons 1 and 9 of the Code of Professional Responsibility, DR 1-102(4) and DR 9-102(B)(4). The panel noted respondent's prior unblemished, the lack of substantial harm to his clients and his efforts to reform certain office procedures.
Following its review of the record, the Attorney Discipline Board affirmed the hearing panel's decision. The respondent's application for leave to appeal was denied by the Supreme Court on June 27, 1989. Costs were assessed in the amount of $1018.40.
