NOTICE OF SUSPENSION (By Consent)

ADB 99-89 George A. Birch, P-38805, Warren, Michigan, by Attorney Discipline Board Macomb County Hearing Panel #5.

1) Suspension - 180 days; 2) Effective May 25, 1989. The respondent was convicted on May 25, 1989 in Macomb County Circuit Court on acceptance of his plea of guilty to possession of less than fifty grams of a controlled substance in violation of MCLA 333.74032(A)(4). In accordance with MCR 9.120, respondent's license to practice law was automatically suspended and he was ordered to show cause why a final order of discipline should not be entered. (See Notice of Interim Suspension dated July 17, 1989.)

The respondent and Grievance Administrator subsequently entered a stipulation for consent order of discipline which was approved by the Attorney Grievance Commission and a hearing panel in accordance with MCR 9.115(F)(5). Respondent is suspended for 180 days effective May 25, 1989. Respondent is currently appealing a sentence imposed by Macomb Circuit Judge Frederick Balkwill. The stipulation further provides that in the event respondent is incarcerated for a further term, his license to practice law shall be suspended automatically on the date of incarceration. The suspension shall continue during the term of incarceration and until respondent's eligibility for reinstatement in accordance with the applicable provisions of MCR 9.123.

Costs were assessed in the amount of $313.33.
