NOTICE OF SUSPENSION ADB 222-87 Peter S. Shek, P-32749, Saginaw, MI by the Attorney Discipline Board increasing a hearing panel order of reprimand to a suspension of ninety days.

1) Suspension - 90 days; 2) Effective April 4, 1989. The hearing panel found that the evidence supported the charges in the five-count complaint that the respondent did not properly segregate client funds from his own and allowed the balance in the account to fall below the amount held on behalf of those clients. The respondent's conduct was found to be in violation of MCR 9.104(1-4) and Canons 1 and 9 of the Code of Professional Responsibility, DR 1-102(A)(1, 6); DR 9-102(A) and DR 9-102(B) (4).

Following consideration of the Petition for Review filed by the Grievance Administrator and the Cross-Petition filed by the respondent, the Board affirmed the panel's factual findings but increased discipline from a reprimand to a suspension of ninety (90) days. The Board specifically cited the mitigating effect of certain personal and emotional problems. Costs were assessed in the amount of $1304.90.
