NOTICE OF REPRIMAND (By Consent)

1) Reprimand; 2) Effective March 1, 1989. The hearing panel accepted a stipulation for consent discipline filed in accordance with MCR 9.115(F)(5) in which the Respondent offered his plea of nolo contendere to Count III of the Formal Complaint. Respondent was retained in January 1985 and instituted litigation on his client#s behalf in Wayne County Circuit Court. The defendant did not appear at the pretrial hearing in April 1987 and the Court instructed Respondent to file a motion to enter judgment. Respondent's failure to file the motion resulted in dismissal of the case and he failed to communicate with his client after March 27, 1987. Respondent's conduct was found to be in violation of MCR 9.104(1-4); and Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); and DR 7-101(A)(1-3). Costs were assessed in the amount of $166.73.
