NOTICE OF SUSPENSION AND RESTITUTION (By Consent)

1) Suspension - nine months; 2) Effective February 3, 1989. The Grievance Administrator and the respondent entered into a stipulation for consent order of discipline which was approved by the Attorney Grievance Commission and a hearing panel in accordance with MCR 9.115(F)(5). Respondent was retained to prosecute a divorce matter. He failed to communicate to his client the status of her case, failed to respond to his client's inquiries regarding her case and failed to respond to the inquiries of successor counsel. In a separate matter, Respondent was appointed to be appellate counsel in a criminal case. He neglected to respond to the inquiries of his client concerning the status of his efforts on behalf of the client. Respondent failed to answer two Requests for Investigation. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2); and Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A) (1,5,6); DR 6-101(A)(3); and DR 7-101(A)(1-3). Costs were assessed in the amount of $110.76. Respondent was ordered to make restitution to the divorce client in the amount of $150.00.
