NOTICE OF SUSPENSION ADB 52-88; 83-88 Russell O. Vail, P-22799, Brighton, Michigan, by the Attorney Discipline Board affirming a Hearing Panel Order of Suspension.
1) Suspension - sixty days; 2) Effective January 10, 1989. The Respondent failed to timely answer the Formal Complaints and failed to file an affidavit of meritorious defense with his motion to set aside default. Respondent's defaults were entered, and the panel determined that the defaults established the allegations of the Formal Complaints. Respondent entered into a written fee agreement with his clients which, in addition to providing for attorney fees for services rendered and to be rendered, guaranteed financial assistance to his clients. Respondent's conduct was found to be in violation of MCR 9.104(1-4) and Canons 1 and 5 of the Code of Professional Responsibility, DR 1-102(A)(5,6) and DR 5-103(B). Costs were assessed in the amount of $183.05.
