1) Reprimand; 2) Effective January 10, 1989. Based upon the evidence presented and the admissions of the respondent, the panel concluded that the respondent entered his appearance in a civil case in October 1982 but failed to take the steps necessary to prevent dismissal of the case for no progress in May 1984; the respondent failed to reply to his client's inquiries regarding the status of that case; and he failed to answer the Request for Investigation served in September 1986. Respondent's conduct was deemed to be in violation of MCR 9.104(1-4,7); MCR 9.113(A)(B)(2) and Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3) and DR 7-101(A) (1-3). The hearing panel discounted the aggravating effect of a prior reprimand for the reason that it was issued subsequent to the acts or omissions alleged in this case. By a majority, the reprimand was imposed. Costs were assessed in the amount of $678.01.
