Respondent's d e f a u l t was en te red and t h e hea r ing panel determined t h a t t h e d e f a u l t e s t a b l i s h e d t h e a l l e g a t i o n s of t h e Formal Complaint. Respondent i n s t i t u t e d d ivo rce proceedings on behal f of h i s c l i e n t i n February, 1986 but took no f u r t h e r a c t i o n i n t h e m a t t e r f o r over a year and a ha l f and c o n t i n u a l l y rendered excuses t o h i s c l i e n t f o r t h e unreasonable de lay i n concluding t h i s u n c o n t e s t e d d i v o r c e . R e s p o n d e n t ' s c o n d u c t was found t o b e i n v i o l a t i o n of MCR 9.104(1-4) and Canons 1, 6 , and 7 of t h e Code o f P ro fe s s iona l Respons ib i l i t y , DR 1-102(A) (1 , 5, 6 ) ; DR 6-101(A) ( 3 ) ; and DR 7-101(A)(1-3) and the panel ordered r e s t i t u t i o n of $210.00 t o t h e Complainant. The Hearing Panel a l s o took i n t o cons ide ra t ion Respondent' s record of p r i o r d i s c i p l i n e which inc ludes a 121 day suspension e f f e c t i v e A p r i l 7, 1981; a 90 day suspens ion by consent e f f e c t i v e J u l y 20, 1982; a 121 day suspension e f f e c t i v e J u l y 11, 1980; and a reprimand e f f e c t i v e August 29,, 1979. Costs were a s se s sed i n t h e amount of $202.60.
