1) Revocation; 2) Effective October 13, 1988. The Respondent did not answer the Formal Complaint and did not appear at the hearing held in Birmingham on July 27, 1988. Respondent's default was entered and the hearing panel determined that the default established the allegations of the Formal Complaint. Respondent failed to represent his client competently and expeditiously in a lawsuit filed on the client's behalf; failed to answer the Request for Investigation and failed to advise his client that he was suspended from the practice of law at the time he represented her. Respondent's conduct was found to be in violation of MCR 9.104 (1-4, 7); MCR 9.103(C); MCR 9.113(B)(2); and MCR 9.119; and Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1, 5, 6); DR 6-101(A)(3); and DR 7-101(A). The hearing panel also took into consideration Respondent's record of prior discipline, which includes a reprimand effective December 20, 1982; a suspension of three years and one day effective March 28, 1986; and a suspension of one year and eleven months effective June 30, 1987. Costs were assessed in the amount $140.28.
