The respondent f a i l e d t o answer t h e formal complaint and f a i l e d t o appear a t t h e scheduled d i s c i p l i n a r y hear ing. Respondent was deemed t o have admi t ted t h e a l l e g a t i o n s contained i n two formal compla in ts , t o w i t , t h a t he was r e t a i n e d by a c l i e n t t o r ep re sen t h e r i n a worker 's d i s a b i l i t y c a s e t a p r e p a r e a w i l l b u t t h a t he f a i l e d t o t a k e a n y a c t i o n o n h i s c l i e n t ' s behalf i n e i t h e r m a t t e r ; t h a t fo l l owing h i s d i s cha rge respondent f a i l e d t o r e t u r n t h e unearned f e e s which had been paid t o him; t h a t he f a i l e d t o answer a Request f o r I n v e s t i g a t i o n ; and t h a t he f a i l e d t o answer a formal complaint. Respondent 's conduct was found t o be i n v i o l a t i o n of MCR 9.104(1-5,7); MCR 9.103(C); MCR 9.113(B)(2) and Canons 1, 6 and 7 of t h e Code of P ro fe s s iona l R e s p o n s i b i l i t y , DR 1-102(A)(1,3-6); DR 6-101(A)(3) and DR 7-101(A)(l-3). Costs were assessed i n t h e amount of $138.04.

A p e t i t i o n f o r review was f i l e d by t h e Grievance Adminis t ra tor seek ing inc reased d i s c i p l i n e i n l i g h t of t h e n a t u r e of t h e misconduct and r e sponden t ' s p r i o r d i s c i p l i n a r y ' h i s t o r y i nc lud ing reprimands i n 1985 and 1987. That p e t i t i o n was pending on September 7, 1988, t h e e f f e c t i v e of respondent ' s disbarment a s t h e r e s u l t of an Order of Revocation e n t e r e d i n ano the r , un re l a t ed ma t t e r (See Notice of Revocation da ted September 8 , , 117-88 and 132-88).
