The Respondent f a i l e d t o answer two Requests f o r I n v e s t i g a t i o n regard ing h i s handl ing of probate mat te rs and f a i l e d t o answer t h e Formal Complaint f i l e d by t h e Grievance Administrator. He appeared be fo re t h e panel which concluded t h a t t h e Respondent's neg lec t of two decedents ' e s t a t e s warranted a reprimand, Upon cons ide ra t ion of a P e t i t i o n f o r Review f i l e d by t h e Grievance Administrator , t h e Attorney Di sc ip l ine Board r u l e d t h a t a p a n e l s h o u l d n o t o v e r l o o k t h e f a i l u r e t o answer R e q u e s t s f o r I n v e s t i g a t i o n o r Formal Complaints. Such f a i l u r e s c o n s t i t u t e s e p a r a t e a c t s o f mi sconduc t p u r s u a n t t o MCR 9 .104(7) . The Board n o t e d t h a t t h e Respondent had a l s o f a i l e d t o a p p e a r i n r e s p o n s e t o a n i n v e s t i g a t i v e subpoena i s sued by t h e Grievance Administrator and he f a i l e d t o appear before t h e Board a t t h e show cause proceedings conducted i n accordance wi th MCR 9.118. The d i s c i p l i n e imposed was inc reased t o a suspension of 120 days. Respondent's conduct w a s i n v i o l a t i o n of MCR 9.104(1-4,7 ) ; MCR 9.103(C); MCR 9.113(B)(2) and Canons 1, 6 and 7 of t h e Code of P r o f e s s i o n a l Respons ib i l i t y , DR 1-102(A)(1,4-6); DR 6-101(A)(3) and DR 7-lOl(A)(l-3). Costs were assessed i n t h e amount of $416.74.
