NOTICE OF REPRIMAND ADB 100-88 Mark Q. Witkowski, P-33021, Battle Creek, Michigan, by the Attorney Discipline Board, affirming a hearing panel Order of Reprimand.
1) Reprimand; 2) Effective August 26, 1988. The Respondent failed to answer the Formal Complaint, but appeared at the hearing in Kalamazoo on June 17, 1988. Respondent's default was entered and the hearing panel determined that the default established the allegations of the Formal Complaint. Respondent's office account check, payable to the Barry County Circuit Court in the sum of $10.00, in payment of a judgment fee was not honored when presented for payment on several occasions because of insufficient funds. Respondent failed to answer the Request for Investigation. Respondent's conduct was found to be in violation of MCR 9.104(1-5, 7); MCR 9.103 (C); MCR 9.113(B)(2); and Canon 1 of the Code of Professional Responsibility, DR 1-102(A)(1, 3-6). The Respondent must obtain a score of seventy percent (70%) or better on the National Professional Responsibility Test, to be taken on or before June 1, 1989. Costs were assessed in the amount of $365.19.
