NOTICE OF REVOCATION ADB 90-88 George H. Furcron, P-13764, Detroit, Michigan, by the Attorney Discipline Board, increasing a Hearing Panel Order of Suspension of three (3) years.

1) Revocation; 2) Effective May 4, 1988. Respondent was appointed Personal Representative of an estate in Wayne County Probate Court. He opened a checking account for the estate; thereafter $9,000.00 was deposited to that account. In violation of his duty as Personal Representative, Respondent failed to maintain the account for the exclusive use and benefit of the estate; misappropriated the funds; failed to pay the inheritance tax on the funds; and falsely prepared, executed and filed an amended inventory of the estate. Respondent also failed to answer the Request for Investigation. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2); and Canons 1 and 9 of the Code of Professional Responsibility, DR 1-102(A)(1,3-6) and DR 9-102(B)(2-4).

In a separate hearing on discipline, the hearing panel recommended that Respondent should be suspended for three years and make full restitution to the estate.

Upon consideration of the serious nature of the misconduct and Respondent's prior disciplinary record, the Attorney Discipline Board affirmed the hearing panel's findings but increased discipline from a suspension of three years to the revocation of the Respondent's license to practice law. Costs were assessed in the amount of $675.72.
