The panel concluded t h a t t h e d e f a u l t cons t i tu ted an admission t o the charges t h a t Respondentreceived t h e sum of $5000.00 t o be held i n t r u s t on behalf of a c l i e n t i n connection with a r e a l e s t a t e t ransact ion . Respondent f a i l e d ' t o deposi t those funds i n t o a separa te account o r t o use the funds on h i s c l i e n t ' s behalf but ins t ead misappropriated the funds f o r h i s own use. Respondent's conduct was found t o be i n v i o l a t i o n of MCR 9.104(1-4) and Canons 1 and 9 of t h e Code of Profess ional Responsib i l i ty , DR 1-102(A)(l ,3-6 DR 9-102(A) and DR

9-102(B)(3,4).

Costs were assessed i n the amount of $101.19.

The panel considered t h e aggravating e f f e c t of Respondent's reprimand i n 1983. Respondent has been suspended continuously s ince November 28, 1986 a s t h e r e s u l t of a one-year s u s p e n s i o n e f f e c t i v e on t h a t d a t e and a three-year suspension i n a subsequent case , e f f e c t i v e December 1, 1987. A sepa ra te case , r e s u l t i n g i n a hearing panel o rde r suspending Respondent's l i c e n s e f o r t h i r t y days, was appealed by t h e Grievance Administrator and was pending, before the Board a t the time Respondent's l i c e n s e was revoked.
