Based upon t h e evidence presented , t h e panel found t h a t t h e Respondent f a i l e d t o d e f e n d h i s c l i e n t d i l i g e n t l y a g a i n s t a s u i t f o r a t t o r n e y f e e s , f a i l e d t o n o t i f y h i s c l i e n t of a mediat ion award, f a i l e d t o answer a Request f o r I n v e s t i g a t i o n and f a i l e d t o make a t imely disbursement of funds c o l l e c t e d on behalf of a c l i e n t . Respondent's conduct was found t o be i n v i o l a t i o n of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2) and Canons 1, 6 , 7 and 9 of t h e Code o f P r o f e s s i o n a l R e s p o n s i b i l i t y , DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(l-3) and DR 9-102(B)(4).
The o r d e r of d i s c i p l i n e i ssued by t h e hear ing panel w a s appealed t o t he Attorney Di sc ip l ine Board by both p a r t i e s . I n an Order da ted May 26, 1988, t h e Board aff i rmed the suspension of 100 days imposed by t h e hea r ing panel bu t modified t h e a d d i t i o n a l condi t ions . Respondent i s r equ i r ed t o complete f i f t e e n hours of cont inuing l e g a l educa t ion wi th in two yea r s . Costs were q s e s s e d i n t h e amount of $1061.42.
