NOTICE OF SUSPENSION ADB 103-88 Joel Simmer, P-20485, West Bloomfield, Michigan, by the Attorney Discipline Board, affirming a Hearing Panel Order of Suspension.
1) Suspension - one year; 2) Effective June 16, 1988. The Respondent admitted in his answer to the Formal Complaint, and at the hearing held in Bloomfield Hills on June 16, 1988, that he failed to notify his clients of a previous one year suspension (DP 111/86), effective February 18, 1987; failed to file a Motion to Withdraw as the attorney of record in pending cases; failed to refrain from holding himself out as an attorney authorized to practice law in the State of Michigan; failed to refrain from practicing law; and failed to answer a Request for Investigation. Respondent's conduct was found to be in violation of MCR 9.104(1-4, 7, 8); MCR 9.103(C); MCR 9.113 (B)(2); MCR 9.119; MCLA 600.916; and Canons 1, 3, 6, and 7 of the Code of Professional Responsibility, DR 1-102(A)(1, 5, 6); DR 3-101(B); DR 6-101(A)(3); and DR 7-101(A)(1-3). Costs were assessed in the amount of $238.38. The discipline imposed by the panel was affirmed by the Attorney Discipline Board in an order dated December 23, 1988.
