NOTICE OF PROBATION (By Consent)

ADB Case No. 232-87 Samuel V. Thomas, P-26693, Detroit, MI, by the Attorney Discipline Board Oakland County Hearing Panel #30.

1) Probation; 2) Effective February 1, 1988. The Formal Complaint filed by the Grievance Administrator charged that the Respondent was retained to institute a personal injury action but he delayed in filing the complaint and allowed his client's cause of action to be barred under the statue of limitations. The Complaint further charged that Respondent failed to provide a full and candid disclosure of the facts and circumstances pertaining to that matter in his answer to a Request for Investigation. Respondent's conduct was alleged to be in violation of MCR 9.104(1-4)(6); MCR 9.113(A) and Canons 1, 6 and 7 of the Code of Professional Responsibility DR 1-102(A)(1)(4-6); DR 6-101(A)(3) and DR 7-101(A)(1-3).

The Hearing Panel approved the terms of a Stipulation for Consent Order of Discipline offered by the parties in accordance with MCR 9.115(F)(5). The Respondent's probation for one year which became effective February 1, 1988 in a previous matter (See Notice of Probation dated July 22, 1988, ADB Case No. 31-87; 49-87; 91-87) is extended for an additional year, February 1, 1989 to January 31, 1990. Costs were assessed in the amount of $797.39.
