The Hear ing Panel considered t h e tes t imony of t h e Respondent and t h e complaining wi tness and concluded t h a t t h e Grievance Adminis t ra tor had e s t a b l i s h e d p r o f e s s i o n a l misconduct by a preponderance of t h e evidence. The Panel found t h a t t h e Respondent was employed t o proba te a deceden t ' s e s t a t e i n January

1984 and took possess ion of va r ious documents i nc lud ing uncashed checks made payable t o t h e decedent. Respondent 's f a i l u r e t o commence proba te proceedings and h i s f a i l u r e t o communicate w i t h t h e c l i e n t o r t o r e t u r n t h e documents t o h e r c o n s t i t u t e d v i o l a t i o n s of MCR 9.104(1-4) and Canons 1 ,2 ,6 6 7 of t h e Code of P r o f e s s i o n a l R e s p o n s i b i l i t y , DR 1-102(A)(l, 5-6); DR 2-1 lO(A)(2) ; DR 6-101(A) ( 3 ) and DR 7-101(A) (1-3).

The Panel noted t h a t s i m i l a r charges of n e g l e c t , f a i l u r e t o communicate wi th a c l i e n t and f a i l u r e t o t u r n over a c l i e n t ' s f i l e i n ano the r c a s e r e s u l t e d i n t h e suspens ion of Respondent 's l i c e n s e f o r a pe r iod of t h i r t y days e f f e c t i v e October 1, 1987. The Panel concluded t h a t a suspension of one y e a r was warranted. Costs were a s se s sed i n t h e amount of $478.90.
