NOTICE OF SUSPENSION (By Consent)

1) Suspension - five (5) years; 2) Effective December 16, 1987. The hearing panel accepted the respondent's plea of nolo contendere to the allegations of the Formal Complaint, and accepted Respondent's consent on the record to a suspension for a period of five years retroactive to December 16, 1987. Respondent was retained in a divorce action and failed to institute garnishment proceedings to enforce the property settlement, failed to respond to his client's inquiries concerning the status of the matter, failed to notify the client of a previous suspension, and failed to answer the Request for Investigation. In a separate matter, Respondent was retained in a civil matter and failed to prosecute the matter, failed to respond to his client's inquiries regarding the status of the matter, failed to respond to his client or opposing counsel concerning settlement of the matter, failed to notify his client of a previous suspension, and failed to answer the Request for Investigation. In a separate matter, Respondent represented an estate in Wayne County Probate Court and failed to notify the personal representative of the court of a previous suspension and continued to practice while suspended. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7,8); MCR 9.103(C); MCR 9.113(B)(2); MCLA 600.916; MSA 27A.916; and Canons 1, 2, 3 , 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,3-6); DR 2-106(A); DR 3-101(B); DR 6-101(A)(3); and DR 7-101(A)(1-3). Costs were assessed in the amount of $128.07.
