funds i n h i s capac i ty a s conserva tor of an e s t a t e and t h a t he oversaw t h e p r e p a r a t i o n and f i l i n g of f a l s e documents wi th t h e Probate Court. The Respondent and t h e Grievance Administrator p e t i t i o n e d t h e Board f o r review of t h e pane l ' s f a c t u a l f i n d i n g s and f o r modi f ica t ion of t h i s d i s c i p l i n e imposed. The Board a f f i rmed t h e pane l ' s f i n d i n g s t h a t funds r e p r e s e n t i n g a n e t r e c o v e r y t o t h e e r t a t e o f $18,880.00 were d e p o s i t e d i n t h e t r u s t account of Respondent's lawfirm on May 11, 1983 but then t r a n s f e r r e d t o t h e f i r m ' s gene ra l account and d i sbu r sed t o persons o t h e r than t h e c l i e n t by June 7 , 1983. The Board a l s o a f f i rmed t h e f i n d i n g t h a t Respondent i n s t r u c t e d h i s c l i e n t s t o s i g n c e r t a i n back-dated notes and r e c e i p t s which were intended t o be f i l e d wi th t h e Probate Court. Two a d d i t i o n a l counts d i s m i s s e d by t h e p a n e l were found by t h e Board t o be a d m i t t e d by Respondent. Those counts a l l e g e d t h a t Respondent knowingly d e l i v e r e d checks t o the c l i e n t and t h e succes so r f i d u c i a r y without s u f f i c i e n t funds i n t h e account. Respondent's conduct was found t o be i n v i o l a t i o n of MCR

7 and 9 of t h e Code of P r o f e s s i o n a l DR 1-102(A)(4-6); DR 6-101(A)(3); DR 7-101(A)(3) and DR Tota l c o s t s i n t h i s ma t t e r were assessed i n t h e amount o f

9.104(1-4) and Canon's 1, 6 , Respons ib i l i t y , 9-102(A)(B)(2-4). $3180.06.
