NOTICE OF SUSPENSION (AMENDED AS TO EFFECTIVE DATE ONLY)

ADB 24-87 Leonard R. Eston, P-13231, Detroit, MI by the Attorney Discipline Board affirming the hearing panel order of suspension.

1) Suspension - three years; 2) Effective August 10, 1987. The hearing panel found that respondent's appearance as an attorney in various District and Circuit Court matters between June 2 and June 10, 1986 constituted a violation of a previous discipline order suspending his license to practice for sixty days. The sixty-day suspension had been stayed during respondent's appeals to the Discipline Board and the Supreme Court but the stay was vacated upon entry of the Court's order denying respondent's application for leave to appeal. Respondent acknowledged that he received actual notice `of that order on May 30, 1986. The panel rejected respondent's affirmative defenses including his claim that he had a reasonable basis for believing that the stay of discipline remained in effect notwithstanding the Court's denial of his appeal. Respondent's conduct was found to be in violation of MCR 9.104 and Canons 1 and 3 of the Code of Professional Responsibility, DR 1-102(A)(4,6) and DR 3-101(B)(3). Costs were assessed in the amount of $523.62.

The order of discipline was affirmed by the Attorney Discipline Board. In an order entered November 17, 1988, respondent's application for leave to appeal was denied by the Supreme Court.
