The Hearing Panel concluded t h a t Respondent committed a c t s of profess ional misconduct by h i s f a i l u r e to f i l e a supplemental b r i e f or to f i l e o ther pleadings on h i s c l i e n t ' s behalf i n a cr iminal appeal d e s p i t e h i s assurances t o the c l i e n t and the c l i e n t ' s family that such ac t ions would be taken. The Hearing Panel noted t h a t the complaint i n t h i s matter might have bean avoided had the p a r t i e s entered i n t o a w r i t t e n agreement describ ing the apecif i c l e g a l se rv ices to b e performed b u t found that once Respondent had accepted a r e t a i n e r to r epresen t the c l i e n t , he was obliged to e x e r t h i s b e s t e f f o r t s to advance the c l i e n t ' s l e g i t i m a t e i n t e r e s t s . Respondent was found t o be i n v i o l a t i o n of MCR 9.'104(2-4) and Canons 1, 2 and 6 of the Code of
Profess ional Responsib ili ty, DR 1-102 (6) ; DR 2-110(3) and DR 6 - l O l ( 1 , Th e Hearing Panel imposed a suspension 180 days, noting a h i s t o r y of p r i o r d i sc ip l ine . On review, the Attorney Disc ip l ine Board affirmed the Panel' s f a c t u a l f indings b u t reduced the d i s c i p l i n e to a suspension of 119 days. Costs were assessed- i n the amount of $755.32.
