NOTICE OF REDUCED DISCIPLINE ADB 36-88 James Bearinger, P-10588, Kalkaska, MI by the Attorney Discipline Board reducing an Attorney Discipline Board Order of Suspension of Four Years.

1) Suspension - two and one-half years; 2) Effective June 30, 1987 The respondent pleaded guilty in the Circuit Court for the Nineteenth Judicial District, Manistee, to the felony of possession of less than 50 grams of cocaine in violation of MCL 333.7403(2) (a). In accordance with MCR 9.120, respondent's license was automatically suspended upon conviction and respondent was ordered to show cause why a final order of discipline should not be entered. Following its review of an order of revocation entered by a hearing panel, the Attorney Discipline Board, by a vote of 5-1, ordered that discipline be reduced to a suspension of four years. Respondent's Motion for Reconsideration was granted and the Board unanimously approved a further order reducing discipline to a suspension of two and one-half years. Costs were assessed in the amount of $634.64.
