Panel Order of Reprimand. 1 ) Suspension - 150 days;
2) Effect ive March 26, 197. The four Count Formal Complaint f i l e d by the Grievance Administrator charged the Respondent with f a i l u r e to i n st i ate divorce proceedings on behalf of a c l i e n t , f a i l u r e to discharge an ob l iga t ion to pay f o r the publ ica t ion of a legal not ice , and f a f l u r e to answer two Requests f o r Inves t igat ion. The Respondent d id n o t answer e i t h e r of the F o d C omplaints and did n o t appear a t t h e h e a r i n g . The Hear ing Pane l found t h a t Respondent ' s misconduct was es tab l i shed and t h a t he had v io la ted the provis ions of MCR 9.104(1-4,7); MCR 9.113(1,2) and Canons 1,6 & 7 of the Code of Profess ional Responsibil i ty, DR 1-102(A)(4-6); DR 6-101(A) (3) and DR 7-101(1-3).
The Reprimand imposed by the Hearing Panel was appealed by the Administrator to the Attorney Disc ipl ine Board which r u l e d t h a t Respondent' s unexplained unwfllingness to respond a t any s t age of the d i s c i p l i n e process warranted a suspension of s u f f i c i e n t l e n g t h t o r e q u i r e t h e f i l i n g o f a P e t i t i o n f o r Reinstatement i n accordance with M C B 9.123(B). The Board r u l e d t h a t a Reprimand o r a s h o r t suspens ion d i d n o t appear t o b e appropr ia te in the case of an a t torney who had u t t e r l y f a i l e d t o
answer o r appear and that protec t ion of the publ ic and the l e g a l system demands that , as a general r u l e , such cases warrant the imposition of a suspension fo r a minimum period of 120 days.
Costs were assessed i n the amount of $120.61.
