In h i s answer t o the Formal Complaint, Respondent admitted that dur ing the course of an a t to rney-c l i en t r e l a t i o n s h i p , he s o l i c i t e d from the c l i e n t a loan to himself of approximately $17,000 based upon a nor %age and mortgage note d r a f t e d by the Respondent. The Panel found the t Respondent' a f a i l u r e to advise h i s c l i e n t of t h e i r d i f f e r i n g i n t e r e s t s was aggrevated by h i s f a i l u r e to repay the borrowed money v o l u n t a r i l y and the r e s u l t i n g l e g a l expenses and l o s s of i n t e r e s t incurred by h i s c l i e n t . Respondent's conduct was found t o be i n v i o l a t i o n of MCR 9.!04(2-4) [GRC 953(2-4)] and Canons 1, 5 and 7 of the Code of P rc fess iona l Respons ib i l i ty DR 1 - 1 0 2 ( ~ ) ( 4 ) , DR 5-104(A), DR
7 - 1 0 1 ( ~ ) ( 3 ) and DR 7 -102(~) (3 ) .
In mi t iga t ion , Respondent a s s e r t e d t h a t h i s a b i l i t y to p r a c t i c e law competently was mate r i a l ly impaired and requested tha t probation be imposed a s provided by MCR 9.121(C). The Panel considered Respondent' s r e h a b i l i t a t i o n e f f o r t s i n mi t iga t ion b u t
ru led t h a t he had n o t e s t ab l i shed h i s e l i g i b i l i t y f o r probation i n accordance with the c o u r t ru le . The Panel a l s o noted the aggrevating e f f e c t of Respondent's p r i o r reprimand i n 1981 and a Consent Order of Probat ion i n 1983. The Panel ordered t h a t Respondent be suspended f o r 119 days and t h a t he reimburse c o s t s i n the amount of $209.53.
