Based upon i ts cons ide ra t ion of the proofs presented i n suppor t of a f i v e Count Complaint f i l e d by the Grievance Adminis t ra tor , the Hearing Panel concluded t h a t misconduct was e s t a b l i s h e d a s charged i n two counts , s p e c i f i c a l l y t h a t dur ing the per iod October 1980 through A p r i l 1981, the Respondent f a i l e d t o m a i n t a i n a c l i e n t t r u s t a c c o u n t b u t i n s t e a d d i s t r i b u t e d c e r t a i n s e t t l emen t funds t o two c l i e n t s a f t e r depos i t i ng the s e t t l e m e n t d r a f t s i n h i s bus iness account and t h a t he f a i l e d to make a n appropr i a t e accounting to those c l i e n t s f o r the s e t t l e m e n t funds and medical b e n e f i t s which he c o l l e c t e d on t h e i r beha l f . Respondent's conduct was found t o be i n v i o l a t i o n of GCR 953(1-4) [now MCR 9.104(1-4)] and Canons 1 and 9 of the Code of P r o f e s s i o n a l Respons ib i l i t y , t o w i t : DR 1 - 1 0 2 ~1 , - 6 DR 9 - 1 0 2 ( ~ ) and DR 9-102(B) (3) .
