The Hearing Panel concluded t h a t the Defau l t en t e red a g a i n s t t h e Responden t f o r h i s f a i l u r e t o answer t h e Formal Complaint cons ti tu ted a n admission t o the a l l e g a t i o n s o f misconduct, t o w i t : that the Respondent had f a i l e d t o comply wi th the requirement contained i n a prev ious Order of D i s c i p l i n e en t e red i n June 1985 that he pay c o s t s . The Panel found that the Respondent 's f a i l u r e t o comply with t h a t p rov i s ion of the Order c o u p l e d w i t h h i s f a i l u r e t o make a l t e r n a t e a r r a n g e m e n t s f o r payment o r to respond to the i n q u i r i e s from the Attorney Grievance Commission cons t i tu ted misconduct i n v i o l a t i o n of MCR 9.104(1-4)(8); MCR 9.128 and Canon 1 of t he Code of P r o f e s s i o n a l R e s p o n s i b i l i t y , t o w i t : DR 1-102(A)(1)(5,6). The Panel Report noted Respondent's previous d i s c i p l i n a r y h i s t o r y c o n s i s t i n g of a suspension of e igh teen months i n 1984 and a 180 day suspension i n 1985. Respondent 's l i c e n s e to p r a c t i c e law was suspended f o r a per iod s i x t y days, and he was ordered t o pay the expenses of the previous d i s c i p l i n e ma t t e r , i n the amount of $206.54, toge ther k i t h c w t s Bss i s sed i n t h i s - a c t i o n i n the amount $85.80.
