him by two c l i e n t s , f a i l e d t o communicate w i t h h i s c l i e n t s regard ing the s t a t u s of t h e i r ca ses and f a i l e d t o answer the Requests f o r I n v e s t i g a t i o n f i l e d by the c l i e n t s and served by the Administrator . I n an Amended Complaint, a n a d d i t i o n a l count charged that Respondent forged the s i g n a t u r e s of h i s c l i e n t s on a s e t t l emen t check i n the amount of $12,000 and misappropriated the se t t l emen t proceeds. The Respondent d id n o t answer the Formal Complaint and d id n o t appear a t the hearing. A t the hear ing , the Administrator r e l i e d upon the Defau l t f i l e d f o r Respondent' s f a i l u r e t o answer and p r e s e n t e d t e s t i m o n y i n s u p p o r t o f t h e a l l e g a t i o n t h a t Respondent f a i l e d to inform h i s c l i e n t s t h a t he had negot ia ted a $12,000 se t t l emen t on t h e i r beha l f , caused the se t t l emen t d r a f t t o be endorsed f r a u d u l e n t l y and deposi ted the e n t i r e proceeds i n h i s personal checking account . The Hearing Panel concluded t h a t Respondent' s p r o f e s s i o n a l misconduct, i n v i o l a t i o n of MCR 9.104(1-4)(7); MCR 9.113(1-2) and Canons 1, 2 , 6 & 7 of t h e Code of P r o f e s s i o n a l R e s p o n s i b i l i t y , t o w i t : DR 1-102(A), DR 2-llO(B)(4), DR 6 - 1 0 1 ( ~ ) ( 3 ) and DR 7-101(~)(1-3) warranted revoca t ion of h i s l i c e n s e to p r a c t i c e l a w . Costs were a s se s sed i n the amount of $160.94.
