e x h i b i t s o f f e r e d by the Grievance Adminis r r a t o r , t h e Panel concluded that the a l l e g a t i o n s of misconduct i n the six (6 ) Count Complaint f i l e d by the Grievance Adminis t ra tor had been e s t a b l i s h e d , to w i t : Count I) Respondent was re t a ined to probate a deceden t ' s e s t a t e i n December 1983 and continued to a c t a s the Pe r sona l Represen ta t ive and a s the Attorney f o r the e s t a t e a f t e r A p r i l 10, 1984, the d a t e of an Order suspending h i s l i c e n s e t o p r a c t i c e law f o r a per iod of t h r e e (3 ) years . On Apr i l 10, 1985, the Respondent f i l e d a P i n a l Account which represented to the

Proba te Court t h a t he held the sum of $151,926.46 a s f i d u c i a r y i n c e r t a i n i d e n t i f i a b l e accounts when, i n f a c t , the balance i n those accounts was $2730.36, the d i f f e r e n c e having been misappropr ia ted to h i s own use. Count 11) t h a t the F i n a l Account f i l e d and executed by Respondent i n t h a t e s t a t e i n Apr i l 1985 was known by him t o be f a l s e . Count 111) t h a t t h e Responden t misrepresented to the Court o r to the I n t e r n a l Revenue Serv ice the amount of the a t t o r n e y f e e s c o l l e c t e d frcm that e s t a t e and t h a t those f e e s were, i n any even t , excess ive . Count IV) t h a t Respondent f i l e d a P e t i t i o n to Commence Proceedings i n ano the r p roba te ma t t e r i n J u l y 1983 b u t f a i l e d to take f u r t h e r a c t i o n on beha l f of that e s t a t e u n t i l h i s suspension a s f i d u c i a r y i n March 1985 . Count V) t h a t i n v i o l a t i o n of t h e terms of t h e O r d e r suspending h i s l i c e n s e i n 1984, the Respondent f a i l e d t o n o t i f y h i s c l i e n t s and /o r the i n t e r e s t e d p a r t i e s i n the above probate m a t t e r s that he was no longer l i censed to p r a c t i c e law. R e s p o n d e n t was found t o have v i o l a t e d t h e p r o v i s i o n s o f MCR 9.104(1-4) and Canons 1 , 2 , 6 , 7 & 9 of the Code of P r o f e s s i o n a l R e s p o n s i b i l i t y , DR 1 -102(~) (4 -6 ) ; DR 2 - 1 0 6 ( ~ ) ( ~ )D;R 6-101(A) (3 ) ; DR 7 - 1 0 1 ( ~ ) ( 1 , 3 ) ; and DR 9 - 1 0 2 ( ~ ) ( 1 , 5 , 6 ) ( ~ ) .
