I n a S t i p u l a t i o n f o r Consent Order of Discipl ine, the Respondent admitted charges of misconduct contained i n the f i r s t count of a Formal Complaint f i l e d by the Grievance Administrator, t o w i t : Tha t d u r i n g t h e c o u r s e of h i s r e p r e s e n t a t i o n of a divorce c l i e n t i n 1971, the Respondent received the sum of $900 which had been ordered to be paid to h i s c l i e n t by the defendant husband. The Respondent deposited those funds i n h i s c l i e n t t r u s t account bu t f a i l e d to n o t i f y h i s c l i e n t of the r e c e i p t of those funds. In 1983, h i s former c l i e n t discovered t h a t the funds had been paid and the Formal Complaint fu r the r charged that the Respondent f a i l e d to answer the w r i t t e n inqu i r i e s from the Attorney Grievance Commission concerning h i s wil l ingness to de l ive r those funds. The Respondent admitted that h i s conduct v io la ted MCR 9.104(1-4) [GCR 1963, 953 1-41 and Canons 1 & 9 of the Code of Professional Responsibil i ty, to w i t : D R ~ - 1 0 2 ( ~ ) ( 5 ) ( 6 ) and DR 9-102(B). By f u r t h e r s t i p u l a t i o n , the second count i n the Formal Complaint was d i smissed . Cos t s were a s s e s s e d i n t h e amount of $107.32.
