The Board, i nc reas ing d i s c i p l i n e on review, a f f inned the Hearing Panel f i nd ings t h a t Respondent d i d n o t commit a n i n t e n t i o n a l m i s a p p r o p r i a t i o n o f f u n d s which o c c u r e d when a n employee of h i s law o f f i c e depos i ted c e r t a i n funds i n Respondent's p ro fe s s iona l account r a t h e r than the c l i e n t t r u s t account . However, the Board r e j e c t e d the Panel f i nd ing t h a t the c l i e n t even tua l ly acquiesced i n Respondent' s r e t e n t i o n of subs tan t i a l sums f o r the ?erformance of unspecif f e d , f u t u r e l e g a l s e r v i c e s . The Board n o t e d , i n i t s O p i n i o n , t h a t a l t h o u g h Responden t d i d u l t i m a t e l y p r o v i d e s e r v i c e s e q u a l t o t h e sum r e t a i n e d , "funds received from o r on behalf of a c l i e n t may be considered a f e e only i f there is s u f f i c i e n t , o b j e c t i v e evidence of r eques t by the c l i e n t f o r s e r v i c e s o r c l i e n t a u t h o r i z a t i o n of r e t a i n e r " .
