Regarding Count 11, the Panel found t h a t Respondent made negl igent misrepresentat ions to a cour t regarding service of process on an adverse par ty i n an e f f o r t t o pe r fec t a d e f a u l t
a g a i n s t s a i d p a r t y ; t h e Pane l found t h a t Respondent d i d n o t i n t en t i o n a l l y deceive the cour t , however, the Panel found an a d d i t i o n a l v i o l a t i o n (a l leged i n Count 111) based upon Respondent' s f a i l u r e to timely execute a s t i p u l a t i o n to set a s i d e sa id improperly entered d e f a u l t judgement forcing opposing counsel to prepare and f i l e a motion to set as ide sa id d e f a u l t
j udgmen t.
F ina l ly , the Panel found t h a t Respondent f a i l e d to make a f u l l and f a i r d i sc losure i n h i s answer to the Grievance Administrator' s Request f o r Inves t igat ion. The Panel found no evidence i n m i t i g a t ion , expressed concern regarding Respondent' s a t t i t u d e toward the Canons of Profess ional Responsibi l i ty and found v io la t ions of MCR 9.104(1-4)(6), MCR 9.113(A) and Canons 1, 6 & 7 , t o w i t : DR 1 - 1 0 2 ( ~ ) ( 5 ) ( 6 ) , DR 6 - 1 0 1 ( ~ ) ( 3 ) and DR 7-lOl(1-3).
