1 ) Suspension - Three Years; 2 ) E f f e c t i v e December 26, 1985. A hearing panel of the A t t o r aey D i s c i p l i n e concluded tha t Respondent committed a c t s of p ro fe s s iona l misconduct a s charged - in a four Count Complaint, to w i t : t h a t Respondent, while a c t i n g a s t h e f i d u c i a r y and temporary p e r s o n a l r e p r e s e n t a t i v e o f a decedent ' s e s t a t e , r ece ived funds belonging t o the e s t a t e i n the amount of $26,875.00, commingled those funds i n h i s personal bus ines s account and misappropriated the funds f o r h i s own use ; t h e Responden t f a i l e d t o p r o p e r l y a d m i n i s t e r t h e e s t a t e by performing c e r t a i n a c t s wi thout proper a u t h o r i t y ; he neg lec t ed the e s t a t e and f a i l e d t o prepare and f i l e necessary accounts i n a t i m e l y manner; and R e s p o n d e n t ' s c o l l e c t i o n of a t t o r n e y f e e s wi thout t he approval of the Probate Court i n the amount $3,025.00 cons ti tu ted a c l e a r l y excess ive fee . Respondent' s conduct was found t o be i n v i o l a t i o n of GCR 953(1-4) [now MCR 9.104(1-4)] and

Canons 1, 2, 6, 7 & 9 of the Code of P ro fe s s iona l R e s p o n s i b i l i t y , DR 1-102(A)(3-6), DR 2-106(A), DR 6-lOl(A)(l-3), DR 7-101(A)(1-3)

and DR 9 -102(~) (B) . The Panel r e j e c t e d Respondent 's r e q u e s t f o r a n Order of Probat ion and ordered t h a t h i s l i c e n s e be suspended f o r a per iod two years . The Hearing Panel dated December 5 , 1985, became e f f e c t i v e December 26, 1985 i n the absence of a P e ti t i on f o r Review by the Respondent.

A P e t i t i o n f o r Review was f i l e d by the Grievance Administrator seeking increased d i s c i p l i n e . By a ma jo r i t y , t he Board concluded t h a t a th ree year suspension was appropr i a t e i n l i g h t of t h e s e r i o u s n a t u r e of t h e m i s c o n d u c t c o u p l e d w i t h s u b s t a n t i a l m i t i g a t i n g f a c t o r s . The Board f u r t h e r modified the

Hearing Panel Order of D i sc ip l ine by imposing add i t i o n a l cond i t i ons of r e in s t a t emen t inc luding the p re sen ta t ion of evidence bear ing upon h i s r e h a b i l i t a t i o n and full r e s t i t u t i o n to
