The hear ing panel found : t h a t Respondent had been appointed t r u s t e e t o manage the l i q u i d a t i o n of a corpora te f i n a n c i a l i n s t i t u t i o n , and s e r v e d i n t h a t capac i ty f o r approximately n i n e years . Respondent misappropriated and converted t o h i s own use and b e n e f i t funds which were the proper ty of t he e n t i t y over which he served a s t r u s t e e on behal f of the S e c u r i t i e s Inves to r P r o t e c t i o n Corpora t i on ; he wrongfully drew checks on t h e t r u s t account and depos i ted the same i n t o a personal account a t ano the r bank o r converted such checks d i r e c t l y t o ca sh t o be used f o r h i s personal b e n e f i t . Respondent e i t h e r forged the name of a United S t a t e s Bankruptcy Judge whose coun te r s igna tu re was necessary on those checks o r a l t e r n a t i v e l y o b t a i n e d the s i g n a t u r e of s a i d judge by use of decept ion. Respondent a l t e r e d o r caused t o be a l t e r e d the endorsements on checks t o i n d i c a t e t h a t they were depos i ted i n l e g i t i m a t e accounts r e l a t e d t o h i s d u t i e s a s t r u s t e e and caused forged c e r t i f i c a t e s of d e p o s i t s t o be l i s t e d among the a s s e t s of the e s t a t e . The Panel found v i o l a t i o n s of GCR 953 ( 1 ) - ( 4 1 , ( 7 ) and Canons 1, 7 , and 9 of t h e Code o f P r o f e s s i o n a l Respons ib i i ty , t o w i t : DR1-102 (A) ( I ) , ( 3 ) - (6 ) , DR7-101 ( A ) (1 ) - (3 ) , DR7-102 (A) (5) - (6) , DR9-102 (A) ( B ) (1 ) - (4) . Respondent f i l e d a n appea l wi th the Attorney D i s c i p l i n e Board, which a f f i rmed the Hearing P a n e l f i n d i n g s and d i s c i p l i n e . Costs i n t he amount of $338.88 were assessed .
