NOTICE OF PROBATION

(1) Probation, (2) For a period of approximately 15 months; ( 3 ) Effective April 13, 1983.

Respondent was charged i n a s i x count complaint with neglect of four separate criminal appeals resu l t ing i n l o s s of r i gh t s or other prejudice t o the client/appellants and f a i l u r e t o answer the requests fo r invest igat ion of the Grievance Administrator i n connection with sa id matters. Respondent was a l so charged with f a i l u r e t o answer the Formal Complaint and a defau l t

was entered. The hearing panel found t h a t " e e gravamen of the professional misconduct al leged i n these (four) counts is t h a t i n each instance Respondent f a i l ed to make timely f i l i n g of a b r ie f with the Michigan Court of Appeals with the r e su l t t h a t the cases were placed i n the Court 's no progress docket and the r i gh t t o o r a l argument was l o s t . These events occurred during the period from June 1981 t o January 1982. In each of these cases the br ie f on appeal was, however, ult imately f i l e d with and accepted by the Michigan Court of Appeals." The defaul t was s e t aside and the Respondent was allowed t o f i l e an answer which admitted the charges i n the complaints, and pleaded cer ta in m i t - igat ion qualifying a s the bas i s fo r probation, to-wit: a cer ta in personal deb i l i t a t i ng condition susceptible t o treatment. The panel considered ce r t a in medical evidence and placed Respondent on probation with spec i f ic conditions fo r continuing treatment.
