The hear ing panel found t h a t Respondent borrowed t h e sum o f $10,000 from a c l i e n t with i n t e r e s t a t 10% t o be secured by a mortgage; t h a t respondent f a i l e d t o advise s a i d c l i e n t t o secure t h e advice of independent counsel regarding s a i d t r a n s a c t i o n and f a i l e d t o give s e c u r i t y f o r t h e loan made t o him i n v i o l a t i o n of GCR 1963, 953(1-4) and Canons 1 and 5 of the Code of P ro fess iona l Responsib i l i ty , to-wit: DR1-102(A) (4-6) and DR5-104(A). The panel considered i n mi t iga t ion t h a t respondent repaid $8,499 of s a i d loan, of which amount $3,862 c o n s t i t u t e d i n t e r e s t and $4,637 c o n s t i t u t e d p r i n c i p a l and t h a t a re- maining balance of $5,362 was being repa id i n a t imely manner. The panel noted t h a t counsel f o r both t h e Grievance Administrator and Respondent suggested t h a t a reprimand was an appropr ia te sanct ion agreeable t o t h e complainant and t h a t t h e r e i s no record of p r i o r
d i s c i p l i n e .
