(1) Suspension; (2) For a period of 30 months; (3) Effective September 1, 1982. The hearing panel found that Respondent in his capacity as an unpaid, volunteer treasurer of a non-profit neighborhood (swimming pool) organization, knowingly and intentionally violated his fiduciary trust to said organization by misappropriating, diverting and converting to his own use funds belonging to said organization in the amount of at least $16,930.00 over a period of many months; that Respondent failed to deliver when requested, all of the books, records, and accounts per- taining to the financial affairs of said organization; that Respondent intentionally concealed or destroyed part of those records; that Re-
spondent submitted certain account balance sheets which he knew contain- ed erroneous information in a deliberate attempt to conceal his misap- propriation of said funds. The hearing panel also found that Respondent was guilty of misconduct due to his failure to file an Answer to the Formal Complaint charging misconduct. The hearing panel found certain
mitigation, to-wit: that Respondent made full restitution to the client and expressed regret and repentance for his actions. The panel found
violations of the Code of Professional Responsibility, to-wit: Canon 1, DRI-102(A) (3) (4) (6) and General Court Rule 953(2) (4).
