This is to inform the Courts of the State of Michigan of the following Order of Discipline: NOTICE OF REPRIMAND File No. DP-140/80 EUGENE F. WILLIAMS, (P223441, 53 North Gratiot, Suite 300, Mt. Clemens, Michigan, 48043, by the Attorney Discipline Board, Wayne Circuit Hearing Panel "E". ( 1) Reprimand; (2) Effective July 28, 1981. The Hearing Panel determined that Respondent was retained in a probate matter and that Respondent was confirmed as Trustee pursuant to the terms of the Trust Agreement and that the Court ordered partial distribution of the assets of the estate, that Respondent failed and/or refused to secure and furnish the required bond causing the Administrator to delay distribution of the assets as approved by the Court, that the Respondent failed and refused to communicate with his client concerning the status of the matter, that additional distributions of sums to the trust beneficiary could not be made due to Respondent's failure to furnish the appropriate bond. The Panel found that gespondent's statement that he would wait until the settlement of an estate-related personal injury case was not just cause for his delay in obtaining the bonds and obtaining the best possible interests on said funds which were to be distributed. The Panel found violations of GCR 953 (1-2) and Canons 1, 6 and 7 of the Code of Professional Rssponsibility, to-wit: DR 1-102, ( 5 1 , DR 6-101, (A) (3) and DR 7-101, (A) ( 2 ) . The Hearing Panel also found that Respondent failed to answer two separate requests for investigation served by the Grievance Administrator, thereby con- stituting separate misconduct in violation of GCR 953 ( 7 ) . A Complainant petitioned the Board to review the Hearing Panel dismissal of one of the original Counts in the original Complaint. After a hearing, the Board affirmed the Panel decision. Respondent was assessed costs in the amount of $619.40.
