This is to inform the Courts of the State of Michigan of the following Order of Discipline :
NOTICE OF SUSPENSION File No. DP-93/80 JOHN M . HOFFMAN, (PI 5042), 31 5 Hubbard Street , Allegan, M I 49010, by Order of the Attorney Discipline Board amending the Panel decision of reprimand.
( 1) Suspension ; ( 2 ) For a period of 120 days; ( 3) Effective April 8, 1981. The Formal Complaint charged: that Respondent was appointed appellant counsel for an indigent prisoner and thereafter failed to file a Claim of Appeal o r otherwise take any action to perfect said appeal, o r to extend the time for perfecting same, resulting in expiration of the r ight of appeal, pursuant to GCR 803, tha t Respondent failed to consult with t he prisoner-client o r otherwise communicate with him regarding his r ights o r the s ta tus of the matter for which Respondent was appointed, in violation of GCR 953(1) ( 2 ) ( 4 ) , and Canon 6 of the Code of Professional Responsibility, to-wit : DR 6-1 01 ( A ) ( 3).
The Panel issued a reprimand, in par t on the basis of lack of informa- tion regarding Respondent's prior record of discipline, which included a reprimand and a 30-day suspension. On review, the Board, in i ts opinion, noted Respondent's prior record of discipline and his failure to answer the
Formal Complaint ( a distinct disciplinary violation). Costs of $366.55 were assessed.
