This is to inform the Courts of the State of Michigan of the following Order of Discipline:

NOTICE OF SUSPENSION File No. DP-195/80 PETER R. BARBARA, (P10418), 2268 City National Bank Building, Detroit, MI 48226, by the Attorney Discipline Board, pursuant to a request for approval of consent discipline agreement between Respondent and the Grievance Administrator.

(1) Suspension; (2) For a period of three ( 3 ) years and one (1) day; (3) Effective February 26, 1981. The Formal Complaint included 15 counts charging that Respondent, having received settlement or judgment proceeds on behalf of separate clients, failed to promptly deliver said funds to the clients in violation of Canons 1 and 9 of the Code of Professional Responsibility, DR 1-102(A) (1) and DR 9-102 (B) ( 4 ) . The Complaint charged delays in payments to clients ranging from two (2) months to seven (7) months involving sums ranging from approximately $915 to $94,215. The Complaint also charged that the clients were eventually paid after they had filed requests for investigation with the Grievance Administrator or after the Grievance Administrator had made contact with Respondent.

A stipulation for consent discipline was submitted to the Attorney Discipline Board by the Attorney Grievance Commission, the Grievance Administrator and Respondent through counsel. The Board conducted a hearing, reviewed relevant documents and case materials and issued an opinion in support of its order approving discipline by consent. The Board Order requires, as a conditionprecedent to any possible future reinstatement, that Respondent satisfy all monetary claims of clients, with interest where appropriate.
