NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITION
Case No. 16-142-GA Notice Issued: February 22, 2018 Terry A. Price, P 43003, Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #28.
Suspension - 300 Days, Effective February 21, 2018 After proceedings in accordance with MCR 9.115, the hearing panel found that respondent committed professional misconduct in his representation of a client in a criminal matter. Respondent attended his client's preliminary exam, but failed to appear for trial or a show cause hearing. Respondent also respondent failed to communicate with successor counselor send the file to successor counsel.
The panel found that respondent neglected a legal matter entrusted to him, in violation of MRPC 1.1 (c); failed to act with reasonable diligence and promptness in representing his client, in violation of MRPC 1.3; failed to take reasonable steps to protect his client's interests upon termination of the representation, in violation of MRPC 1.16(d); failed to surrender papers and property to which the client was entitled, in violation of MRPC 1.16(d); and knowingly disobeyed an obligation under the rules of a tribunal except for an open refusal based on an assertion that no valid obligation exists, in violation of MRPC 3.4(c). Respondent was also found to have violated MCR 9.104(1)-(3); and MRPC 8.4(c).
The panel ordered that respondent's license to practice law be suspended for a period of 300 days and that he be required to pay restitution to Marquis Palmer in the amount of $9,000.00. Costs were assessed in the a of $2,483.57. /l~L-q,
