The m a t t e r was r e f e r r e d t o Oakland C i r c u i t Hearing Pane l "G" of t h e D i s c i p l i n e Board f o r h e a r i n g and recommendation a s t o a p p r o p r i a t e d i s c i p l i n e . The Pane l found t h a t t h e a l l e g a t i o n s i n t h e Complaint had been proven. The Pane l c o n s i d e r e d s e v e r a l m i t i g a t i n g
f a c t o r s , i n c l u d i n g Respondent ' s vo lun ta ry withdrawal from t h e p r a c t i c e of law f o r more than two ( 2 ) y e a r s , and e f f o r t s a t p e r s o n a l r e h a b i l i t a t i o n a s w e l l a s Respondent ' s l e v e l of competence, response t o t h e r a p y , and se l f -awareness of t h e problems p r e c i p i t a t i n g h i s
defalcation. The Panel's recommendation of a Suspension of 90 days was adopted by the Discipline Board. Respondent was assessed costs of $322.10.
