The Formal Complaint charged that Respondent was convicted af ter a jury t r ia l in the United States Dist r ic t Court, Eastern Dist r ic t o f Michigan, on the charge o f conspiracy to possess wi th intent to d is t r ibute and dist r ibu- tion o f marijuana, in violation o f 21 U.S.C. 841 ( a ) ( l ) and 846.
The Hearing Panel determined that there was sufficient evidence o f the conviction. No evidence was considered in mitigation, inasmuch as Res- pondent denied gui l t o f the criminal charge; stay o f the discipline pending appeal o f the conviction was denied. The United States Sixth Circui t Court o f Appeals denied Respondent's criminal appeal while his Petition for Review was pending before the Attorney Discipline Board. Costs were assessed in the amount o f $527.37. I
