Respondent was charged i n a two-count Formal Complaint with: Repeated misrepresentations t o a c l i e n t i n a personal in ju ry matter t h a t s a id matter had been s e t t l e d ; issuance of a check i n the amount of $10,000 t o sa id c l i e n t which was returned f o r i n s u f f i - c i e n t funds, subsequent misrepresentations t o the c l i e n t t h a t the case had i n e f f e c t not been s e t t l e d . The Complaint al leged t h a t the Court f i l e disclosed t h a t the matter had been s e t t l e d fo r a sum of $7,000 and t h a t Respondent f a i l ed and refused to pay s a id funds and converted t he same t o h i s own use. The Formal Complaint a l so charges Respondent with f a i l u r e t o answer the Grievance Admin- i s t r a t o r ' s Request f o r Invest igat ion. The Complaint a l leged viola- t ions of Canon 1 , DR 1-1 02 ( A ) (1 ) (3-5), Canon 9, DR 9-102 (B) (1-4) , and GCR 962.1, . 2 and GCR 953 ( 7 ) . The Hearing Panel found t h a t Respondent did not pay a t l e a s t $4,636 of s a id se t t lement and t h a t Respondent had engaged in conduct involving dishonesty, f raud, dece i t and misrepresenta- t i on , cons t i t u t i ng v io la t ions of Canon 1 , DR 1-102 (A) ( 4 ) and Canon 9 , DR 9-102 (B) ( 4 ) .
