Respondent was charged i n a three count Formal Complaint a l l e g i n g improper hand1 i n g o f c l i e n t funds, i s su ing a check wi thout s u f f i c i e n t funds, f a i l u r e t o prompt ly pay o r n o t i f y sa id c l i e n t regarding r e c e i p t o f sa id funds; wh i le a c t i n g as a t to rney f o r the f i d u c i a r y o f an esta te , personnal ly borrowed subs tan t ia l sums under a loan agreement p a r t i a l l y guaranteed by the execut r ix o f sa i d esta te , f a i l e d t o f i l e a Motion f o r Withdrawal a f t e r re l inqu ish ing r e s p o n s i b i l i t y f o r the f i l e of sa id esta te , f a i l u r e t o

provide sa id execu t r i x o f Not ice o f a Claim against sa i d estate; wh i le act ing, os tens ib ly , on beha l f o f a t h i r d par ty , induc ing the execu t r i x of said esta te t o make a loan o f $20,000.00 from her personal funds, issuance o f checks i n repayment o f sa id loan which were dishonored upon presentment, f a i l u r e t o make f u l l d i sc losure regarding Respondent's a b i l i t y t o repay

said loans, f a i l u r e t o advise sa id c l i e n t t o seek the advice of independent counsel regarding the a d v i s a b i l i t y o f sa id loans and f a i l u r e o r neglect t o protect the investment o f sa i d c l i e n t .

Regarding Count I invo l v i ng Respondent's f a i 1 u re t o p roper l y handle the funds of a c l i e n t received pursuant t o a consent judgment, the

hearing panel found t h a t the a l l ega t i ons i n the complaint were proven and t ha t Respondent had comningled and converted sa id funds. Count I 1 o f the

complaint i n vo l v i ng t h e making o f a l oan p a r t i a l l y guaranteed by a c l i e n t and f a i l u r e t o n o t i f y sa i d c l i en t - execu t r i x o f a c l a im against the es ta te represented, was dismissed upon motion o f counsel fo r the Grievance Administrator. The panel concluded t h a t the fac tua l a l l ega t i ons i n Count I11 o f the complaint were proven; however, the panel found no v i o l a t i o n DR 7-101 (A) (2) i n v o l v i n g f a i l u r e t o ca r r y ou t a con t rac t o f employment o r

DR 6-101 (A) (3) i n v o l v i n g neglect o f the matter. The panel d i d f i n d v i o l a t i ons of the fo l low ing ru les : Canon 1, DR 1-102 ( A ) (3-6), Canon 5 , DR 5-101 (A), DR 5-1 04 (A), Canon 6, DR 6-101 (A) (3 ) , Canon 7, DR 7-1 01 (A) (21 , Canon 9, DR 9-102 (B) (1 ) ( 4 ) .
