NOTICE OF REPRIMAND (By Consent)

Case No. 02-105-GA Notice Issued: April 17, 2003 John J. Holler, III, P 43344, Wyandotte, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #16.

1. Reprimand; 2. Effective April 15, 2003; The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s admission to the allegations that he failed to perfect an appeal on behalf of his client or to protect his opportunity to appeal; failed to communicate with his client regarding the status of his matter; failed to explain to his client the issues relating to his matter; abandoned the representation of his client without notice to his client and without taking reasonable action to protect his interests; and failed to withdraw from his client=s representation to allow for the appointment of substitute counsel.

Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.16(a)(3) and (d); 3.2; and 8.4(a) and (c). The parties agreed that respondent should be reprimanded. Costs were assessed in the amount of $792.91.
