ROGER E. GARDNER (PI 3845), 3521 4 Caryn, Farmington H i 1 1s , Michigan 48018, by Oakland County Hearing Panel #5, e f fec t ive March 6, 1979. The decision of the Panel was not appealed t o the Discipline Board. Respondent was charged w i t h four separate counts of misconduct including al legat ions of : neglect of c i v i l l i t i g a t i o n resul t ing i n a default judgment against a c l i e n t who had prepaid at torney 's fees , negotiation of a 1o an of substant ial funds by fraudulent misrepresentations and issuance of three checks against accounts not bearing su f f i c i en t funds; f a i lu re t o carry out a contract of employment, neglect of said matter, engaging in the unauthorized pract ice of law while under an Order of Suspension of the former Sta te Bar Grievance Board; f a i l u r e t o i n s t i t u t e a c i v i l s u i t f o r which Respondent received a re ta iner f ee , and the making of f a l s e representations regarding the progress of said s u i t ; and, f a i lu re t o respond t o the Grievance Administrator's Request for Investigation re l a t ive t o the aforementioned misconduct. Regarding Count I1 of the Complaint, the panel did not f ind a violation of discipl inary ru les prohibiting conduct of moral turpi tude, dishonesty, fraud, dece i t , misrepresentation o r conduct i n violat ion of GCR 953 (1-4), but did f ind tha t Respondent had fa i l ed t o answer the Request for Investigation. Count 111, involving issuance of one check without suf f ic ient funds, engaging in the pract ice of law under an Order of Suspension and neglect of one legal matter, was dismissed due t o the fa i lure of the or ig ina l complaining witness t o appear.
Regarding Count I , the panel found violat ions of GCR 953. (1) .(2) (3) (4) and (7) , Canon 1 , DR 1-102 (A) (1) (4) (5) and ( 6 ) , Canon 6 CR 6-101 ( A ) (2) and ( 3 ) , Canon 7 , DR 7-1 01 (A) (1 ) (2) , and GCR 962.2 (b). Regarding Count IV, the panel found violat ions of Canon 1 , DR 1-102 ( A ) (3) (4) (5) and ( 6 ) , Canon 6, DR 6-1 01 (A) ( 3 ) , Canon 7 , DR 7-1 01 e (A) (1 ) (2) , GCR 953 (1 -4) , (7 ) , and G
