NOTICE OF REPRIMAND (By Consent)

Case No. 17 -50-GA Notice Issued: December 8,2017 Daniel J. Rust, P 32856, Redford, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #21.

Reprimand, Effective December 8, 2017. The Grievance Administrator filed a formal complaint alleging that respondent committed professional misconduct while acting as court appointed appellate counsel in a criminal matter. A default was entered for respondent's failure to answer the formal complaint and the parties later filed a Stipulation for Consent Order of Discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel.

Based upon respondent's default, admissions, and the stipulation of the parties, the panel found that respondent handled a legal matter without preparation adequate under the circumstances, in violation of MRPC 1.1 (b).

In accordance with the stipulation of the parties, the panel ordered that respondent be reprimanded. Costs were assessed in the amount of $1,102.72.
