NOTICE OF REPRIMAND WITH CONDITIONS (By Consent)

Case No. 16-100-GA Notice Issued: September 5, 2017 Jamal J. Hamood, P 40442, Rochester, Michigan, by the Attorney Discipline Board Tri­ County Hearing Panel #61.

Reprimand, Effective September 2,2017. The respondent and the Grievance Administrator filed a Stipulation for Consent Order of Discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel.

Based upon respondent's admissions and the stipulation of the parties, the panel found that respondent failed to keep only client or third person funds in an IOlTA, in violation of MRPC 1.15(a)(3); failed to hold property of a client or a third person in connection with a representation separate from the lawyer's own property, in violation of MRPC 1.15(d); deposited his own funds in a client trust account in an amount more than reasonably necessary to pay financial institution charges or fees or to obtain a waiver of such charges or fees, in violation of MRPC 1.15(f); and used a client trust account in violation of MRPC 1.15A(a). Respondent was also found to have violated MCR 9.104(2) and MRPC 8.4(a).

In accordance with the stipulation of the parties, the panel ordered that respondent be reprimanded, along with the conditions that respondent attend the seminar entitled "lawyer Trust Accounts: Management Principles and Record Keeping Resources," offered by the State Bar of Michigan; and provide monthly IOlTA bank statements and reconciliation statements for every client trust account to the Attorney Grievance Commission. Costs were assessed in the amount of $965.78.
