The Grievance Administrator petitioned the Attorney Discipline Board for review of the order of Ingham County Hearing Panel #2, dated April 25, 2013, suspending the license to practice law of respondent, Peter C. Mason, Jr., for a period of two years with condition. The Attorney Discipline Board has conducted review proceedings in accordance with MCR 9.118, including review of the record before the hearing panel and consideration of the arguments and briefs presented by the parties. For the reasons discussed in the attached opinion, discipline is increased to disbarment with condition.

NOW THEREFORE, IT IS ORDERED that respondent, Peter C. Mason, Jr., is DISBARRED from the practice law in Michigan EFFECTIVE JUNE 1, 2013, and until further order of the Supreme Court, the Attorney Discipline Board or a hearing panel, and until respondent complies with the requirements of MCR 9.123(B) and (C) and MeR 9.124.

IT IS FURTHER ORDERED that respondent shall immediately resign as trustee of the Joyce A. Messenger Revocable Trust, and, within 14 days of the date of this order, file proof of his resignation as trustee and Successor Trustee Thomas Jewett's acceptance as trustee with the Grievance Administrator and the Attorney Discipline Board.

IT IS FURTHER ORDERED that from the effective date of this order and until reinstatement in accordance with the applicable provisions of MCR 9.123, respondent is forbidden from practicing law in any form; appearing as an attorney before any court, judge, justice, board, commission or other public authority; or holding himself out as an attorney by any means.

IT IS FURTHER ORDERED that the respondent shall comply with all applicable provisions of MCR 9.119.

IT IS FURTHER ORDERED that respondent shall, on or before October 16, 2013, pay court reporting costs incurred by the Board for the review hearing conducted on July 10, 2013, in the amount of $47.63. This amount is in addition to the costs previously assessed in the amount of $2,072.91 in the hearing panel's order issued April 25, 2013. These costs are also subject to interest. Check or money order shall be made payable to the State Bar of Michigan, but submitted to the Attorney Discipline Board [211 West Fort St., Ste. 1410, Detroit, MI 48226] for proper crediting.
